Terms of Service
Welcome to Noctua. These Terms of Service ("Terms") govern your use of the Noctua mobile application and any related website, content, or services we provide (collectively, the "Service"), operated by Noctua ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
If you do not agree, please do not use the Service.

1. Eligibility & accounts
You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to use the Service. If you are under 18, you confirm that a parent or legal guardian has reviewed these Terms.
To use most features you must create an account, either by signing in with Apple, Google, or by registering an email and password. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us promptly at hello@noctuaapp.io if you believe your account has been compromised.
2. The Service
Noctua delivers one short, AI-curated insight per day across topics you choose, along with optional features that let you go deeper (an AI chat about the article), test yourself, and remember what you read via spaced-recall practice. The exact set of features and limits may evolve over time.
We reserve the right to add, remove, or modify features at any time. We will use reasonable efforts to notify you of material changes that affect your paid subscription.
3. Subscriptions, trials & billing
Trial
New users may receive a free trial period (currently 7 days). At the end of the trial, your selected subscription will begin and your payment method on file with the platform store (Apple App Store on iOS, Google Play on Android) will be charged automatically, unless you cancel before the trial ends.
Billing through the platform store
All purchases are processed by the platform store you used to install the app — Apple for iOS users (subject to Apple's Media Services Terms) or Google for Android users (subject to Google Play's Terms of Service). We do not see, store, or process your payment details. Subscriptions auto-renew at the price displayed at sign-up unless canceled at least 24 hours before the end of the current period.
Cancellation & refunds
You can cancel a subscription at any time:
- iOS: Settings → [your name] → Subscriptions → Noctua.
- Android: Play Store → your profile icon → Payments & subscriptions → Subscriptions → Noctua.
Cancellation takes effect at the end of the current billing period. Refunds, where applicable, are handled directly by Apple or Google under their respective policies. We are not able to issue refunds directly for App Store or Google Play purchases.
Price changes
We may change subscription prices going forward. Any price change will be communicated to you in advance and will only apply to renewals after the change. You may cancel before the new price takes effect.
4. AI-generated content
The insights, summaries, quizzes, and follow-up answers in Noctua are produced or assisted by artificial intelligence systems, currently including but not limited to large language models from Anthropic and embedding models from OpenAI. We curate, prompt, and review our pipeline carefully, but AI output can occasionally be inaccurate, incomplete, or out of date.
The Service is provided for educational and informational purposes only. It is not medical, legal, financial, psychological, or other professional advice. Do not rely on Noctua content for decisions where accuracy matters; consult a qualified professional instead.

5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Attempt to access, scrape, copy, mirror, or republish substantial portions of the Service's content without our prior written permission.
- Reverse-engineer, decompile, or attempt to extract the source code of the app, except as expressly permitted by applicable law.
- Use the Go Deeper AI chat to generate content that is illegal, abusive, harassing, defamatory, infringing, hateful, sexually explicit involving minors, or otherwise objectionable.
- Probe, scan, or test the vulnerability of any system or network of the Service, or breach any security or authentication measures.
- Interfere with, disrupt, or impose an unreasonable load on our infrastructure.
- Use the Service to develop a competing product, train a machine-learning model, or build a dataset for resale.
6. Intellectual property
The Service, including its text, code, design, branding, audio narrations, and original imagery, is the property of Noctua and its licensors and is protected by copyright, trademark, and other laws. We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.
You may share insight cards and quotes generated through the Service's "share" features on social platforms, with attribution to Noctua. Beyond that, you may not reproduce, distribute, or create derivative works of the Service's content without our prior written consent.
7. Third-party services
Noctua integrates with third-party services to deliver the product, including:
- Apple and Google — sign-in (SSO).
- Apple App Store, Google Play, and RevenueCat — subscription billing.
- OneSignal — push notification delivery (via Apple APNs on iOS and Firebase Cloud Messaging on Android).
- Anthropic Claude and OpenAI — AI content generation and embeddings.
- Resend — transactional email.
Each of these has its own terms and privacy practices. We are not responsible for third-party services beyond our integration with them.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not guarantee that the Service will meet your expectations, be error-free, or be available at all times.
9. Limitation of liability
To the maximum extent permitted by law, in no event will Noctua, its founders, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service.
Our total liability to you for any claim arising out of or relating to the Service is limited to the amount you paid Noctua in the twelve months preceding the claim, or USD $50, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages — in those jurisdictions, the limitations above apply only to the extent permitted.
10. Indemnification
You agree to defend, indemnify, and hold harmless Noctua and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or the rights of a third party.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service if you breach these Terms or if we reasonably believe your use is harmful to other users, third parties, or the Service itself. We will use reasonable efforts to notify you of such suspension or termination when feasible.
You can delete your account at any time from inside the app (Profile → Sign out, then contact hello@noctuaapp.io to request data deletion) or by emailing us.
12. Changes to the Service or these Terms
We may update these Terms from time to time. If the changes are material, we will notify you in the app or by email at least 14 days before they take effect. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.
13. Governing law & disputes
These Terms are governed by the laws of your country of residence, except where the laws of your country require local rules to apply. Any disputes will be resolved in the courts of competent jurisdiction in your country of residence, unless we mutually agree otherwise.
Nothing in these Terms limits your statutory rights as a consumer where such rights cannot be waived.
